General Terms and Conditions and House Rules for the Outdoor Park

IKUNA Naturresort GmbH Naturpfad 1, A-4723 Natternbach (hereinafter referred to as “IKUNA”)

1. Day Visitor Outdoor (Nature Adventure Park)

1.1. Seasons

1.1.1. Outdoor Summer Season

The outdoor summer season runs from April 1 to October 31 of a calendar year. The exact dates may vary slightly from year to year. The binding dates will be published on the website www.ikuna.at.

1.1.2. Outdoor Winter Season

The outdoor winter season runs from November 20 to January 31 of the following calendar year. The exact dates may vary slightly from year to year. The binding dates will be published on the website www.ikuna.at.

1.2. Admission Entitlements & Payment

1.2.1. Tickets & Validity

For the seasons listed under section 1.1, day admission tickets are offered in different categories. Tickets are available online as well as on site via ticket machines and ticket counters.

Special offers or promotions are available online only.

The purchased ticket is valid exclusively for admission during the season purchased and may be redeemed on any day within that season.

If a ticket is not redeemed within the applicable season, it expires and loses its validity. There is no entitlement to a refund or extension.

Children under the age of 4 are admitted free of charge. No distinction is made between child and adult tickets.

The following ticket categories are available:

1.2.1.1. Single Day Ticket

The ticket is valid for one person only.

1.2.1.2. Family Day Ticket

When purchasing a family day ticket, five persons (two adults and three children) are taken as the basis.

Five individual tickets are issued at the price of the family ticket.

For online purchases, tickets are delivered digitally.

All tickets within a family group must be redeemed on the same day. If this condition is not met, the tickets lose their validity.

IKUNA reserves the right to conduct checks. In the event of improper use, the family ticket may be withdrawn. There is no entitlement to a refund.

For on-site purchases, children must be specified at the ticket counter or added at the ticket machine.

1.2.1.3. Group Day Ticket

The group day rate is available for groups of 20 persons or more.

Each additional person pays the individual price displayed on site.

1.2.1.4. Season Passes

Season passes are valid across calendar years, beginning with the respective winter season and ending with the following summer season.

Season passes are personalized and printed with:

• a photo of the cardholder

• the cardholder’s name

• the cardholder’s date of birth

No deposit is charged for season passes. Passing the cards on to third parties is not permitted.

Checks are carried out on site. In the event of non-compliant use, the season pass will be blocked. There is no entitlement to a refund.

A family season pass may be issued for two adults and three children.

1.2.2. Discounts

Tickets may be purchased at a discounted rate through the following cooperation partners:

• Upper Austrian Family Card

• Salzburg Family Card

• SN Advantage Card

• OÖN Card

• NÖN Card

• Raiffeisen, Raiffeisen Club and Sumsi Club members

• Sparkasse Eferding / Peuerbach / Waizenkirchen

Only these cooperation partners are accepted.

Discounts offered as part of promotions are available online only and valid exclusively for the respective promotional period.

There is no entitlement to a refund or price difference for tickets already purchased.

1.2.3. Accepted Payment Methods

The following payment methods are accepted:

• Cash in euros (banknotes up to EUR 100 only)

• Maestro card

• Visa

• Mastercard

Foreign currencies are not accepted. No change can be given.

Tickets purchased on site are non-refundable.

For online purchases, the statutory right of withdrawal applies unless the ticket has already been redeemed within the withdrawal period.

Upon redemption, the right of withdrawal expires for all tickets within the ticket group.

1.2.4. No Refund After Admission

Once admission has been granted, there is no entitlement to a refund.

1.3. Right of Admission & Opening Hours

Admission to the IKUNA premises is permitted exclusively with a valid admission ticket and only via the designated visitor entrances 1 and 2.

The right to enter and remain on the premises applies exclusively during the officially published opening hours of the respective area.

In the event of early closure due to technical, organizational, operational or weather-related reasons, the premises must be vacated immediately.

There is no entitlement to a refund of the day ticket.

IKUNA reserves the right to close the outdoor park on individual days of the season without stating reasons. Notices are published on www.ikuna.at.

If arrival occurs on a closure day, there is no entitlement to compensation or ticket exchange.

1.4. Animals

Animals of any kind are not permitted on the park premises and must be removed immediately in case of non-compliance.

If the guest refuses to comply, external specialists may be called in. All resulting costs shall be borne exclusively by the park guest.

Exceptions apply to assistance and support animals for park guests. In such cases, an official certificate must be presented.

The animal must not move freely and must remain permanently connected to its owner (e.g. on a leash).

The owner is liable for the animal and its behavior.

1.5. Bringing bulky objects is prohibited.

1.6. Bringing food is tolerated; packaging waste must be taken home.

1.7. Smoking is prohibited except in designated smoking areas.

1.8. Theft and vandalism will be reported to the authorities.

1.9. Parents are liable for their children at all times.

1.10. Play equipment may only be used in accordance with posted safety instructions and at one’s own risk.

1.11. Use of play equipment under the influence of alcohol or drugs is prohibited.

1.12. Drones and means of transportation are not permitted.

1.13. The entire premises are under video surveillance.

1.14. IKUNA reserves the right to close individual areas without stating reasons.

1.15. By entering the premises, the day visitor accepts these General Terms and Conditions.

1.16. The use of play equipment under the influence of alcohol and/or drugs is prohibited.

1.17. Each participant must assess their own physical and mental fitness before using any play equipment and must observe the posted safety instructions.IKUNA assumes no liability for damages resulting from overestimation of one’s own abilities or comparable misconduct.

1.18. The entire IKUNA premises are under video surveillance. Video surveillance is carried out for the protection of guests, employees and property.

1.19. Water taps and water pipes installed below a height of 50 cm, as well as water inlets or outlets on play equipment, are not drinking water sources and are not suitable for consumption.

1.20. Grilling is permitted only at designated grilling areas.Only the wood provided by IKUNA may be used. Breaking off branches or damaging vegetation is prohibited.

1.21. IKUNA reserves the right to close individual areas of the park without stating reasons.

1.22. Artistic performances and children’s programs may be changed in content or cancelled at short notice. There is no entitlement to a refund in such cases.

1.23. The distribution of brochures, flyers or advertising material from third parties is prohibited and requires the prior approval of IKUNA management.

1.24. Images, videos, audio recordings or photographs taken by visitors on the park premises may only be used for personal and non-commercial purposes, unless prior written consent has been expressly granted by IKUNA.

1.25. No winter maintenance service is provided within the IKUNA premises.

1.26. Access to the IKUNA premises outside official opening hours is not permitted, including for holders of season passes.

1.27. By entering the IKUNA premises, the day outdoor visitor expressly accepts these General Terms and Conditions.

General Terms and Conditions and House Rules for overnight guests

2 Hotel & Overnight Guests (Naturresort & Camping Resort)

2.1 Scope of Application

These General Terms and Conditions apply to all hotel and overnight guests of IKUNA Naturresort GmbH (e.g. chalets, tipis, themed accommodations or comparable forms of accommodation).

By completing a booking, and at the latest upon arrival, the overnight guest accepts these Terms and Conditions.

2.2 Booking & Conclusion of Contract

2.2.1 Bookings may be made online or in writing by email.

2.2.2 The accommodation contract is concluded upon booking confirmation by IKUNA.

2.2.3 Bookings are personal and non-transferable.

2.3 Prices & Payment

2.3.1 The prices published at the time of booking shall apply.

2.3.2 Unless stated otherwise, prices are quoted per accommodation unit and per night.

2.3.3 IKUNA is entitled to request deposits or advance payments. As a rule, 50% of the total stay must be paid within 7 days of receipt of the booking confirmation.

2.3.4 Accepted methods of payment are cash in euros, Maestro, Visa and Mastercard.

2.4 Arrival & Departure

2.4.1 Check-in is possible on the day of arrival from 3:00 p.m.

2.4.2 Check-out must take place on the day of departure by 10:00 a.m.

2.4.3 In the event of a late check-out, IKUNA is entitled to charge an additional overnight stay or an appropriate fee.

2.5 Cancellation, No-Show & Early Departure

2.5.1 Cancellations must be made in writing.

2.5.2 The cancellation conditions in accordance with the Austrian Hotel Contract Conditions 2006 (AGBH 2006) apply:

• up to 3 months before the day of arrival: no cancellation fee

• 3 months to 1 month before the day of arrival: 40% of the total price

• 1 month to 1 week before the day of arrival: 70% of the total price

• within the last week before the day of arrival: 90% of the total price

2.5.3 In the event of non-arrival (“no-show”), the entire booking amount will be charged.

2.5.4 Early departure does not entitle the guest to a refund.

2.6 Use of the Outdoor Park

2.6.1 Admission to the IKUNA Outdoor Park is included in the booking for overnight guests and applies to the entire family listed in the booking contract.

The included park admission is valid:

• on the day of arrival from 3:00 p.m. (check-in), and

• on the day of departure until 10:00 a.m. (check-out).

If the family wishes to use the outdoor park before check-in on the day of arrival or after check-out on the day of departure, day tickets for the entire family may be purchased at the reception at a 50% discounted rate.

2.6.2 Use of the outdoor park is additionally subject to the Terms and Conditions for Day Visitors Outdoor (Nature Adventure Park).

2.6.3 Operational or weather-related restrictions do not entitle guests to a refund.

2.7 House Rights & Conduct

2.7.1 Overnight guests must behave in a manner that does not disturb or impair other guests, the operation, facilities or staff.

2.7.2 In particular, noise disturbances, damage to property or serious violations of these Terms and Conditions are prohibited.

2.7.3 The designated quiet hours must be observed.

2.7.4 In the event of violations, IKUNA is entitled to terminate the stay prematurely; there is no entitlement to a refund.

2.8 Children & Supervision

2.8.1 Parents or legal guardians are liable for their children throughout the entire stay.

2.8.2 IKUNA does not assume any duty of supervision.

2.9 Animals

2.9.1 Camping Resort

Dogs are permitted in the camping resort. No additional fee is charged for dogs.

2.9.2 Naturresort (Tipis, Chalets, Garden Rooms)

Dogs are permitted in the Naturresort area (tipis, chalets and garden rooms).

A fee of EUR 36.00 per dog per night (excluding food) will be charged.

2.9.3 Public Areas

In all public areas of the IKUNA premises, dogs must be kept on a leash at all times and, where required, wear a muzzle.

2.9.4 Liability

The owner is liable for all damage or contamination caused by the animal.

IKUNA reserves the right to take appropriate measures in the event of violations of these regulations.

2.10 Smoking, Fire & Grilling Regulations

2.10.1 Smoking is strictly prohibited in all accommodations.

2.10.2 In the event of violations, IKUNA is entitled to charge cleaning and loss-of-use costs.

2.10.3 Open fires are permitted only in designated areas.

2.11 Damage & Inventory

2.11.1 Accommodations and inventory must be treated with care.

2.11.2 Damage or extraordinary soiling will be charged to the overnight guest.

2.12 Liability

2.12.1 IKUNA shall not be liable for slight negligence, except in cases of personal injury.

2.12.2 IKUNA shall be liable for items brought in only within the scope of the statutory provisions (§ 970 Austrian Civil Code – ABGB).

2.12.3 The overnight guest is liable for damage caused by themselves or their fellow travelers.

2.13 Parking

2.13.1 Vehicles may be parked only in designated areas.

2.13.2 Improperly parked vehicles may be towed at the owner’s expense.

2.13.3 IKUNA assumes no liability for vehicles or their contents.

2.14 Video Surveillance

Publicly accessible areas of the premises are subject to video surveillance.

2.15 Force Majeure

In the event of force majeure (e.g. severe weather, official orders), there is no entitlement to compensation or refund.

2.16 Final Provisions

Austrian law shall apply. The place of jurisdiction shall be – insofar as legally permissible – the court with subject-matter jurisdiction at the registered office of IKUNA Naturresort GmbH.
